Marketplace Fairness Act of 2013
This proposed bill has passed the Senate and the process is waiting on a similar House bill, as of September 26th. The House in the last week has been discussing about other issues such as Wild Fires, Unemployment and Health Care.
The bill would enable state governments to require remote retailers with no physical presence in their state to pay sales taxes. However, it is impractical for online businesses to manage sales taxes for potentially all fifty states. The bill does illustrate, it would appear, that states are not currently able to put forth such regulations, as would be in conflict with California ABx1 28. The California bill, if understood correctly, regulates online businesses to pay sales taxes that have cumulative sales of tangible property to purchasers in California of over a half million US dollars.
